Veteran tech company IBM has filed a lawsuit against one of its former executives and asked him to return a bonus of Rs 4 crore given by the company. IBM has done this case when the executive joined one of their rival companies. In a lawsuit filed in a New York court, The company said the executive’s name is Patama Chantaruk and she is the former general manager of its Thailand-based unit. IBM said that Patama has joined its rival company named ‘Accenture’ in violation of the terms of his employment.
The company said Accenture is its biggest competitor in the Asia-Pacific region in terms of consulting revenue.
Patama Chantaruk joined IBM in the year 2018. Last year he resigned from the company and about a month later in April 2022 he joined Accenture as Thailand Managing Direct.
IBM said it had given Chantaruk about $4.7 million (about Rs 4 crore) as a bonus or compensation for not accepting a job with a rival company for a certain period of time. The company told that this bonus was given so that the confidential information of the company would be safe and the rival company could not use this information.
The company said in its application for the lawsuit that his rapid move to Accenture gave the company the right to cancel his bonus. IBM reported that they had previously contacted Chantaruk demanding a refund, but he declined. After this, the company had to take legal recourse.
